Supreme Court ruling - BC’s Immediate Roadside Prohibition legislation was struck down

Despite the Supreme Court ruling, wherein certain provisions of BC’s Immediate Roadside Prohibition legislation was struck down, West Vancouver Police remain committed to detecting and apprehending drivers who, despite all of the publicity, feel that they may now drive a motor vehicle while under the influence of alcohol.

Over the weekend, West Vancouver Police arrested two people, in separate incidents, while also conducting a third impaired driving investigation within the community.

On December 4, 2011, at 4:30 a.m., a vehicle was stopped at a WVPD road check at the north end of the Lions Gate Bridge. During the impaired driving investigation, the 22-year-old female driver assaulted a police officer by kicking him several times before being taken into custody and eventually providing a breath sample of 130 mgs (.13). She now faces criminal charges of Impaired Driving and Assaulting a Police Officer.

In a second incident on December 4, 2011, police responded to a single vehicle motor vehicle crash that occurred in the 1400-block of the Trans Canada Highway. The lone occupant driver was taken to hospital with undetermined injuries. Alcohol is believed to be a factor and West Vancouver Police are continuing with their investigation.

In a third incident that occurred on December 4, 2011, around 11:30 p.m., a report was received by West Vancouver Police that a vehicle was observed traveling in the wrong direction on the Trans Canada Highway. The driver was taken into custody and provided a breath sample of 220 mgs(.22), which is almost three times over the legal limit of 80 mgs (.08).

Chief Constable Peter Lepine states, “The community of West Vancouver can be assured that their police service will be out in full force as they look for impaired drivers within our community. Additional or extra enforcement Counter Attack Road Checks events, as well as regular road checks, will be particularly prevalent over the holiday season”.
